The seller provides the buyer with all information regarding contact details, the ordering process, delivery time and method, technical specifications of the offered products, payment terms, prices, contract withdrawal and product return costs.

User – any natural person or person acting on behalf of a legal entity who is on the online store website https://sense.si/

The purpose of the general terms and conditions of the online store https://sense.si/ is to clearly define the sales conditions between the seller and each buyer and to regulate the operation of the online store https://sense.si/. According to the contract, a buyer is understood to be any natural or legal person who makes a purchase on the website https://sense.si/, regardless of whether they are a natural person/consumer or not.

These general terms and conditions are drafted in accordance with the applicable laws of the Republic of Slovenia and apply to all users of this website.

Orders in the online store https://sense.si/ can be placed in Slovenian 24 hours a day, 7 days a week. Products are selected and ordered from the product list on the website. All products listed on https://sense.si/ are available while supplies last. Prices are presented as “online prices.”

Online prices apply exclusively to online sales and may differ from prices in the seller’s physical retail locations.

Prices are valid at the time the order is placed and have no fixed validity period. They may change without prior notice. All prices are shown in euros (€) and include value-added tax (VAT). The seller is a VAT-registered entity. Payment is made in cash upon personal pickup or upon receipt of goods by mail or by invoice.

Although we strive to provide the most accurate and up-to-date pricing information, errors may occur. In such cases, or if the price of an item changes during order processing, the buyer will be allowed to withdraw from the purchase, and the seller will propose a mutually satisfactory solution.

Funds paid via invoice do not accrue interest.

The product price, VAT amount, and shipping costs are clearly displayed in the shopping cart before you complete your order.

There are no product deliveries through the website https://sense.si/, as the company SENSE WELLNESS PRIVE d.o.o. only offers the sale of gift vouchers online. Upon payment, the customer receives the gift voucher via the email address provided in the purchase form.

Material defects are very rare in practice. If the buyer believes that the purchased items did not have the properties necessary for their normal use or trade at the time of purchase, or in other cases defined as material defects by the Consumer Protection Act, they must notify the seller properly and no later than within two months from the day the defect was discovered. In the notification, to facilitate handling, the buyer should describe the defect precisely and allow the seller to inspect the item. The seller will resolve material defects and complaints in accordance with the provisions of the Obligations Code and the Consumer Protection Act.

In the case of gift vouchers, a material defect can only be an incorrectly specified gift voucher. The buyer has purchased and paid for a voucher for a certain service, within a certain value and time frame, but the voucher they receive does not match these details.

Complaints and claims regarding items can be sent by the buyer to the email address: sense@sense.si.

The seller commits to protecting, processing, and storing all personal data of users and buyers in accordance with the provisions of the Personal Data Protection Act.

The website for ordering products and downloads is protected and adequately secured both technically and electronically. The seller commits to taking all reasonable security measures to ensure the safety of all payment data during the buyer’s order process, but is not liable for possible data theft unless it results from the seller’s negligent conduct.

The seller stores the IP addresses of all users of the online store https://sense.si/ for the legally prescribed period. For registered members, the seller also stores: full name, email address, contact telephone number, fax number, residence address and delivery address, time and date of registration, and communication archives with the seller.

The seller will use personal data solely for the purpose of fulfilling the order (sending informational materials, offers, invoices) and other necessary communication. User data will never be disclosed to unauthorized persons.

The seller will also use personal data for direct marketing purposes and to analyze purchasing habits based on purchased products, allowing for targeted marketing. The user may at any time request in writing that the seller permanently or temporarily cease using personal and purchase data for the aforementioned purposes.

The data controller is SENSE WELLNESS PRIVE d.o.o. and its authorized employees who manage the database. For the purpose of program implementation, analysis, and various inquiries, the controller may cooperate with external partners with whom appropriate data protection agreements have been concluded.

Users or buyers are also responsible for protecting their personal data by safeguarding their username and password and ensuring adequate software (antivirus) protection of their information system.

It is considered that by accepting the general terms and conditions of the online store https://sense.si/ and completing the registration, the user explicitly consents to the use and processing of their personal data. Based on this consent, the data controller may process personal data for the purposes specified in this section.

By accepting these general terms and conditions, the user or buyer also acknowledges their right to access, correct, copy, supplement, block, or delete personal data relating to them, in accordance with the applicable data protection legislation.

The seller will contact the user via remote communication means only if the user does not explicitly object to this, and in accordance with the provisions of ZEKom-1 (Electronic Communications Act).

The seller’s promotional electronic messages will include the following elements:

  • They will be clearly and unambiguously marked as advertising messages,
  • The sender will be clearly identifiable,
  • Various campaigns, promotions, and other marketing techniques will be clearly labeled as such, with clearly defined participation terms,
  • The method for unsubscribing from receiving advertising messages will be clearly presented,
  • The seller will explicitly respect the user’s wish not to receive advertising messages.

User opinions, comments, and product reviews written by users or buyers are part of the store’s functionality and are intended for the user community. The seller allows any store user to write a review. The seller will delete any opinions or contributions that are offensive in any way or, in the seller’s opinion, do not provide value to other users and visitors after review.

By submitting a review or comment, the user explicitly agrees to these terms and grants the seller permission to publish part or all of the text in all electronic and other media. The seller has the right to use the content indefinitely and for any purpose related to the seller’s business interests, including publication in advertisements or other marketing communications.

The author of the review simultaneously declares and guarantees that they own the material and moral copyrights to the written reviews and comments and that these rights are exclusively and indefinitely transferred to the seller.

The seller strives to ensure the accuracy and timeliness of the information published on its website. However, product characteristics, delivery times, or prices may change so quickly that the seller is unable to update the website data immediately. In such cases, the seller will notify the buyer of the changes and allow them to cancel the order or exchange the ordered product or will offer a solution satisfactory to both parties.

The seller aims to provide appropriate photographs for all products on the website, but these are only symbolic. Any differences between the photograph and the actual product do not affect the product specifications. Decorative items shown in the photos are not included in the offer and are not part of the order. Materials (photos, attachments, and others) are copyrighted and owned by the manufacturer or the authorized partner for the respective product groups.

The seller is not responsible for the content of product reviews written by users. The seller does not guarantee the accuracy of information in reviews and disclaims any liability arising from the information contained in user reviews.

A user can make a purchase on the online store https://sense.si/ either as a guest or as a registered user. The registered user creates an account by obtaining a username, which is the user’s email address and a password chosen by the user. The username and password clearly identify and link the user with the entered data, so that a registered user does not need to re-enter the required personal information during subsequent logins to the online store https://sense.si/. Registration is also possible during the purchase process.

If a registered user wishes to change their email address later, they must send a request to sense@sense.si. The email change will be made on the same day or the next working day, and the user will be informed by email.

To select a product/voucher, click “Add to cart.” You can check the selected items by clicking on “My cart,” and when you proceed to check out, you will be automatically redirected to choose whether to complete the purchase as a “Guest” or “Registered user.”

By clicking “Add to cart,” the buyer declares:

  • that they are at least 18 years old in accordance with the law,
  • that they have full legal capacity.

Before purchasing, you must provide the required contact details (full name/company name, residential address/company headquarters, phone number, email address), which are necessary to confirm and complete the order and deliver the product. At least one valid phone number must be entered.

If the order is successfully submitted, the message “Order has been successfully submitted” will appear on the website. Additionally, an email with the order details will be sent to the email address provided during the order.

The purchase contract is stored electronically on the seller’s server and is accessible at any time to the registered user in their user profile. For guest users, the purchase contract is available upon request by contacting the seller at sense@sense.si or by phone at +386 (0)30 388 388. The contract is stored for the legally required period in accordance with applicable legislation and accounting standards.

The purchase contract between the seller and the buyer is concluded at the moment the seller sends the buyer the first email confirming the status of their order.

After placing the order, you will receive an email (subject: Order Receipt Confirmation) with your order details and confirmation that your order has been placed and recorded. From that moment, all prices and other terms are fixed and binding for both seller and buyer. The email will also inform you of the right to withdraw from the contract (applicable only to consumers, i.e., individual buyers) and where to turn in case of delivery delays or complaints.

Registered users always have full access to detailed order status and content on the online store website https://sense.si/. The seller reviews the order, checks product availability, and confirms or rejects the order with reason. The seller may contact the buyer by phone to verify information or ensure accurate delivery. For products not in the seller’s stock, delivery depends entirely on the supplier’s delivery times. The seller will keep the buyer informed by email about delivery status. If the delivery time is too long and the buyer does not wish to wait, they may inform the seller who will remove the item from the order and refund any payments made. Other items will be delivered or the entire order canceled, according to the buyer’s choice. If the supplier does not confirm product availability within one month from the order date, the seller may reject the order due to unavailability. Upon rejection, the order ceases to be valid. The seller is not responsible for damages caused by extended delivery times or the unavailability of products not in stock.

The seller prepares, ships or prepares the product for personal pickup within the agreed timeframe and informs the buyer by email.

Orders are processed every working day, Monday to Friday from 9:00 to 21:00, and Saturday, Sunday, and holidays from 13:00 to 21:00, in the order they are received.

Purchases made through the online store https://sense.si/ are considered purchases conducted under the legal system of the Republic of Slovenia.

Payment via Bank Transfer to the Seller’s Business Account Based on an Offer/Proforma Invoice

For certain orders, we reserve the right to require payment via bank transfer to the seller’s business account based on an offer or proforma invoice.

The seller will issue the buyer an invoice with an itemized breakdown of costs and send it in .pdf format to the buyer’s email address no later than on the day of delivery or personal pickup of the ordered goods.

In the case of personal pickup at the designated location, the buyer must present a printed invoice for the purchased items, thereby confirming their order and the right to collect the ordered goods.

The buyer is informed about all details of the online order via the email address provided during checkout. If the buyer does not receive an email with this information, it is possible that an incorrect email address was entered.

Therefore, the company strives to resolve any disputes amicably and to the best of its ability.

Out-of-Court Consumer Dispute Resolution

In accordance with legal provisions, SENSE WELLNESS PRIVE d.o.o. does not recognize any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute that a consumer may initiate in accordance with the Out-of-Court Settlement of Consumer Disputes Act.
